Guard Thy Rights: When Advocates Bend to the Establishment, Citizens Need Be Concerned

"The prohibition is general. No clause in the Constitution could by any rule of construction be conceived to give to Congress a power to disarm the people. Such a flagitious attempt could only be made under some general pretense by a state legislature. But if in any blind pursuit of inordinate power, either should attempt it, this amendment may be appealed to as a restraint on both."

— William Rawle, A View of the Constitution 125-6 (2nd ed. 1829)

There is a constant drumbeat in America.  It is the Left's persistent, almost insatiable, need to control the past, present, and future through its mighty narratives and charming messengers.  Since the last Presidential Election, they have displayed their Resistance by a show of force and by deadly force itself.  They are protected by the Wealth of Wall Street, the Representative Power of the Establishment on Capitol Hill, and the Unrelenting Presentation of Myth and Rhetoric expressed as News.  What worsens this plight is the sincere desire of those that say that they stand with Samuel Adams, Thomas Jefferson, and George Mason as vibrant conservatives buckle when the heat of induced public opinion weighs heavily on the optics of the day.  The drummers and fifers of revolution doggedly play in the distance declaring that freedom and liberty are under attack from those that will never settle for gleeful compromise or a share of power.  Shall they disarm the citizenry?  Just as surely as those on the Establishment Right seek to conquest those willing to patriotically honor the Nation.

There are, indeed, Urban American "conservatives" that find great ease in standing for what they deem is conservatism and yet, abhor the optics of standing with those that the Left condemn as "Alt-Right Conservatives".  The Urban "Conservatives", whom I would label wannabes, have spent generations attempting to find common ground and "convince" Leftists to partner in "changing the community".  They can not understand how those "Alt-Right Conservatives" could possibly waste their time boycotting the National Football League (NFL).  How dare you challenge the Leftists and their egalitarian protectors for "protesting the NFL's lack of patriotism"?  The wannabes portend that it is a waste of time to reject the NFL due to its mercenary patriotism.  They contend that we can't win over the Leftists if we protest their right to adhere to the First Amendment.  Number one, President Donald Trump started it and number two, the NFL is "too big to fail".  If you "Alt-Right Conservatives" keep boycotting then, you will miss good football.  You are not making any difference.  At least, not any real difference is being made by you Alt-Right Conservatives and the optics are really bad.

It's amazing that the wannabes never admit that it was the Left that initiated anti-Patriotic protests against the American flag, our military and law enforcement, and our National Anthem.  Even worse, the Left attempted to extort employment for their Che Guevara champion Colin "Take A Knee" Kaepernick by initiating boycotts against the NFL“There will be no football in the state of Georgia if Colin Kaepernick is not on a training camp roster and given an opportunity to pursue his career,” said Gerald Griggs of the Atlanta NAACP branch.  The wannabes persist that the Alt-Right should take no standard for the sake of optics yet, the Left may take as many standards as are necessary to promote their narrative and agenda to overthrow the Nation.  Yes, the Left can reverently boycott America and the NFL  at once but, you gosh darn patriots are messing up opportunities to find a compromise with them.

The wannabes want the "Alt-Right Conservatives" to just understand how tough it is for them to go into the Barber Shop and declare the principles of conservatism. Their argument, "One more week of spreading the Good News of Tax Cuts, Regulation Reform, and Building A Wall and I would have been able to register everyone in the shop for the Republican Party."  What should the "Alt-Right Conservatives" do?  Maybe we can admit that "one hand up and don't point the gun in my general direction" will be an acceptable compromise.  Maybe if we agree to take down every Civil War statue in America that fathers will come home to raise illegitimate children, homicides will cease, and college students will switch their majors from social sciences and communications to science, technology, and math to reduce cultural unemployment.  Maybe if we would just apologize for the systemic racism that exists in this Nation, that was the first to abolish slavery by a War Between the States, and stand arm linked with each other singing kumbayah that they will allow us to stand and peaceably honor the National Anthem and the American Flag.

Yeah, how is that theory working, wannabes?

We allegedly hear from Colin that for the right price of employment that it can be done.  For the US Dollar, he would stand for the flag.  I don't suggest buying any NFL Player's Jersey until the embarrassment for honoring our Nation has been removed from the hearts and souls of the players.

By the way, the results of the "Alt-Right Conservatives" is phenomenal.  According to Breitbart, "A new Rasmussen poll finds that 32 percent of adults surveyed say that they have stopped watching NFL football because of the protests while only a scant 13 percent said they are more likely to tune in because of the anthem protests."  I know wannabes say that is scantly anecdotal.  There could be no real cost to the NFL.  The players are still being paid.  Indeed, todat is today but, it is not tomorrow.  This one thing may impact the NFL Players pay in the 2020-2022 Collective Bargaining Agreement Negotiations: Television Ratings!

The owners will not have to shop at Aldi's or Shoppers Food Warehouse anytime soon.  They are frugally living off a $5 Billion television deal.  However, payback will be a real female dog if ratings continue to fall.  If ratings drop, the television networks will have to reimburse advertisers.  At $535,000 for a 30-second slot on Thursday Night Football, that's a chuck out of the Leftist's Media Treasury that they certainly do not desire to lose.  A few more months and the prideful promoters of Marxism may return to NFL Headquarters and advise that the remaining balance of the TV deal will need to be renegotiated.   The owners will not make this their burden alone.  State and Local governments may find it more difficult to negotiate tax based financing for stadiums.  If capitalist consumers continue to take their kids to soccer games and wives to dinner on Sundays, the Fidel Castro t-shirt wearing players will see that contract negotiations will become tenser.  Veteran Day Weekend Boycotts shall surely make a poetic difference.  Yes, patriots, you have been successful despite the wannabes' chastisements.

Imagine the wannabes' knee-jerk reaction to the mass political savagery in Las Vegas, NV.  O, how dreadful you "Alt-Right Conservatives" truly are.  You suspect a Leftist's conspiracy and profanely promulgate the claims of the Islamic State of Iraq and Syria (ISIS).  As a fine, upstanding wannabe, I would not dare even entertain such gossip.  Have we not the time to honor the dead and care for the injured.  We can not by any means sling salacious tinder about those on the Left and their allies.  You guys make the optics look really bad.

It is this commitment to the purity of sight, hearing, taste, smell, and touch as agreed to and reported by the Leftists that discounts the validity of query by the Right.  We must not consider any options that are offensive to the Left, for they possess the moral high ground in every mass incident that involves a gun.  The Left takes no moral allegiance to the individual incidents by repeat offenders in gun control cities like Chicago.  Such law offenders find the criminal justice system an appeasement organization that rewards those that live outside the boundaries of the law and curses those that abide faithfully the will of the empowered criminal advocates.  In fact, in such cities, the criminal is hailed as the victim and honored as hero.  Rather than implore the fullest inspection of fact, the wannabes condemn.  It is better to be seen as a uniter than divider in the court of public opinion.  This keeps a wannabe's visit to the "Curvy Couch", no matter how unlikely, certainly a possibility.

How routine is it for the Right to knee-jerk react to the Left?  It is as routine as Lebron James measuring the intelligence quotient of Ohioans.   The knee-jerk reaction by those on the Right to a mass shooting is more than a reasonable expectation.  Former Secretary of State Hillary Clinton blames the National Rifle Association (NRA) for the mass shooting rather than Stephen Paddock and Senator John Cornyn of Texas trembles:

“I own a lot of guns, and as a hunter and sportsman, I think that’s our right as Americans, but I don’t understand the use of this bump stock.  It seems like it’s an obvious area we ought to explore and see if it’s something Congress needs to act on.”

It is amazing that those with the responsibility of protecting the Second Amendment find it so easy to diminish its Constitutional role in American culture.  The Second Amendment is not about the rights of Bubba and Jimmy Joe to go hunting in the Ozarks one Saturday morning.  The Second Amendment is not about the rights of Marty Hayes or Massad Ayoob to participate in the National Trophy Infantry Team Match.

"[The Constitution preserves] the advantage of being armed which Americans possess over the people of almost every other nation...(where) the governments are afraid to trust the people with arms." --James Madison, The Federalist Papers, No. 46

"What country can preserve its liberties if its rulers are not warned from time to time that their people preserve the spirit of resistance? Let them take arms."
-- Thomas Jefferson to William Stephens Smith, 1787. ME 6:373, Papers 12:356

"Certainly one of the chief guarantees of freedom under any government, no matter how popular and respected, is the right of citizens to keep and bear arms ... The right of citizens to bear arms is just one guarantee against arbitrary government, one more safeguard, against the tyranny which now appears remote in America but which historically has proven to be always possible."
-- Hubert H. Humphrey, Senator, Vice President, 22 October 1959

The importance of gun ownership is to secure the people from the knee-jerk efforts of those that would rather rule than serve.  It is the greatest assurance that a citizen may stand, in force, against a tyrannical, entrenched government.  If the Number Two Republican in the US Senate has forgotten his way then, I believe it is time to send a reminder to him, Texas.  In four years, Lone Star State, you may wish to send to Washington, DC a citizen-servant that understands the weight of his or her role in protecting our natural rights rather than attempting to appease these rights away to the Left.

Which leads us to the double-mindedness of those that are supposed to advocate hardest to guarantee and protect our Second Amendment.  There is one amongst us that appears more than willing to surrender our rights depending on the latest public opinion poll--the NRA.  There is one that remains strong and faithful to the foundations of our Constitution--Gun Owners of America (GOA).   On Thursday, when government rulers deigned that it was the bump stock that killed 58 people and injured over 500 and not Paddock, the NRA surrendered to the outcry for more regulations.  They released the following announcement via press release:

Despite the fact that the Obama administration approved the sale of bump fire stocks on at least two occasions, the National Rifle Association is calling on the Bureau of Alcohol, Tobacco, Firearms, and Explosives (BATFE) to immediately review whether these devices comply with federal law.  The NRA believes that devices designed to allow semi-automatic rifles to function like fully-automatic rifles should be subject to additional regulations.

On Sunday, the NRA received the Political Holy Ghost and backtracked on their earlier beliefs.  Chris Cox, NRA Institute for Legislative Action Executive Director, told Fox News Sunday that "it [NRA] would oppose an outright ban on bump-stock devices".

What a difference three days makes.

GOA never bent.  They made certain on Thursday that America knew which organization would stand for the Constitution, even when it's not politically correct.  Eric Pratt, GAO Executive Director made it crystal clear:

“Gun Owners of America opposes a ban on bump stocks. Bump stocks were approved by the ATF during the Obama administration to help gun owners with disabilities fire their weapons.  Any type of ban will be ignored by criminals and only serve to disarm honest citizens.  Perhaps that’s why 91 percent of police believe a so-called “assault weapons” ban will have no effect or a negative effect on crime.  And given that 95 percent of cops think that a ban on large capacity magazines would be ineffective in reducing violent crime, it’s hard to imagine they would regard bump stocks any differently."

Makes you think, which of these institutions will really back the Constitution in the midst of political correctness onslaught: NRA or GOA?  Wannabes want you to believe that if the "Alt-Right Conservatives" would just give on bump stocks then, the Left would be willing to give on something else.  Yes, they have adopted the President Franklin Delano Roosevelt "New Deal" philosophy: exchange your liberties for government security.  Otherwise, the optics would look really bad.  Supreme Court Justice Clarence Thomas makes it abundantly clear that we must not surrender to the tyrannical state:

For those of us who work in marbled halls, guarded constantly by a vigilant and dedicated police force, the guarantees of the Second Amendment might seem antiquated and superfluous… But the Framers made a clear choice: They reserved to all Americans the right to bear arms for self-defense. I do not think we should stand by idly while a State denies its citizens that right, particularly when their very lives may depend on it…

Thank God that there are those that are willing to stand for freedom and liberty even when the Barber Shop Crowd would ridicule the rational.

There is a constant drumbeat in America.  The Left has misdirected our focuses to a bump stock when gun violence is not the greatest threat to American lives.   The Left has initiated a full-on attack of America since 1972.  Abortion has left many Americans dull of senses yet, wannabes want us to believe that optics towards conservatives will change if we would not identify and publish this truth to the world.  We are not in a place to submit to give and take with the Left.  In Urban America, despite strict gun control, the Leftists allow the pursuit of violence.  The Left condemn conservatives for being unfeeling and uncaring to the point that they are willing to lose their jobs to maintain that narrative.  Life, liberty, and the pursuit of happiness matters not.  The Revolution matters only.  The Resistance is merely stepping it up with Jihadi alliances and radical insurrectionists.  The Left has but one objective: overthrow freedom and liberty.  The drums continue to play and will not cease until the objective is met.

Repeal the State and Local Tax Deduction: Ending the Leftists' States' Manipulation of the US Treasury

One of the best lessons that I ever learned about lobbying and federal subsidy came by way of my wife and daughters.  Although I saw myself as a hard-core disciplinarian parent committed to the principles of frugality, my daughters, and my wife, were far more wise to my weaknesses as a father.  Yes, I loved and spoiled my daughters.  They were so cute, so sweet, and so smart.  They would look at me with their adoring eyes as I threatened to pound flesh and they would walk away with only a verbal warning.  They were my babies and they knew how to stroke Daddy's ego well.

"O, father, you are so wise.  Please tell us again your opinions on the Sixteenth Amendment."

My daughters would normally ask me such questions at about bedtime, in my home office where the cable television link broadcast.  Swollen with great pride that they had chosen me as their historical link to American politics and economics, I was more than willing to bend the strict regard for their bedtimes and enter into a brilliantly lain outline of study on US Income Taxes.  I was more than honored that they sought my expertise, on a school night, and did not want to disappoint them in the delivery of my knowledge.

Where shall I begin?  O, yes, they must know of Frederic Bastiat.  Indeed, indeed, they must.  For it is he who said, “Everyone wants to live at the expense of the state. They forget that the state lives at the expense of everyone.”  One of the great tragedies of taxation is that everyone wants access to everyone else's wealth, intellectual property, and assets so that their pursuit of wealth creation may be aptly funded.  Bully, bully, they are excited by such discourse.  They are so darling!

O, yes, I will pass you the remote control as you listen so adamantly and nod your heads with such great comprehension.

I will speak of the Great Progressive Republican folly of President Theodore "Teddy" Roosevelt and the "Insurgent" Republicans in securing the federal income tax via Constitutional Amendment.  The sexiness of having a larger government with a bigger military was too attractive to the Establishment Republicans of the day and their socialist friend, Victor Louis Berger, in Congress, that they could not resist.  Teddy said, "Therefore, I believe in a graduated income tax on big fortunes, and in another tax which is far more easily collected and far more effective, a graduated inheritance tax on big fortunes, properly safeguarded against evasion, and increasing rapidly in amount with the size of the estate.”

Yes, o, yes, ladies, you may turn from the football game to SpongeBob.  I can sense that you are very comfortable learning as much as you can about tax history.

By the way, it was the threat of central governance that many conservatives feared would come to pass if the income tax passed Congress and became a Constitutional Amendment.

Yes, ladies, you may have some of my popcorn and root beer but, not too much because it is late in the evening.

Our Founding Fathers never wanted the Nation to have governance and economic power centralized in Washington, DC.  Created in the revolution of the taxation tyranny executed from London by the Monarchy, American Capitalists wanted a Nation that respected the natural rights of men, women, and children to produce profits without the inane pursuit of government to intervene or inhibit business growth.

O, yes, baby girl, go downstairs and bring back blankets and pillows for you and your sister.

However, from the time of the Mayflower Compact in Massachusetts, there have been those that wanted to socialize the arts and sciences of wealth creation, creating strong arm interventionists strategies.  William Bradford, in his journal, revealed the futility of socialism firsthand:

“The experience that we had in this common course and condition, tried sundry years...that by taking away property, and bringing community into a common wealth, would make them happy and flourishing – as if they were wiser than God.”

"For this community (so far as it was) was found to breed much confusion and discontent, and retard much employment that would have been to their benefit and comfort. For young men that were most able and fit for labor and service did repine that they should spend their time and strength to work for other men's wives and children without [being paid] that was thought injustice.”

“This [free enterprise] had very good success, for it made all hands industrious, so as much more corn was planted than otherwise would have been.”

Today, we call the artisans of the Mayflower Compact socialists.  No matter what you say or evidence produced, they reject any notion that the redistribution of wealth and control of production and prices by the government will fail.

Others have longed for a fiercely strong federal government regulating the authority of individual states, the engines of capitalism,  and fashioning society slowly into a socialist state.  These are known today as progressives and they convince the "working or middle" class to become jealous of the rich or those that inherit wealth.  The intent is to institute a government that makes the life of the poor less arduous, allowing monies to be directed by tax from the wealthy to improve their lives.

Daddy, are progressives Democrats that you don't like or Republicans that you do like?

O, little lady, that is such a great question!  I am so glad that you are listening to your Daddy.  Sure, I'll turn the volume up but, just a little.  I don't want your Mommy to know that y'all are up after your bedtime on a school night.  Babies, progressives are both Democrats and Republicans.  They are now known as the Establishment.  Their objective is to grow the government and restrict the individual.  They prefer to be the smooth operators of socialism.  They subscribe to the power of the pen and the calculator.  They use the pen to write legislation and their bureaucrats write regulations that go directly to the wallets of the capitalists, their sworn enemy.  The Progressive Establishment believe that they can tax and spend our way into human equality.  They, like the British loyalists during the Revolutionary War and the Federalists thereafter, believe that a strong central government and a central bank will assure the equality of mankind.  Socialists believe in the New Deal.  Progressives believe in the Square Deal.  Between the two, Americans end up getting a Raw Deal.

Daddy Ken, when did the Patriots give up the reigns of free capitalism to the Socialists and Progressives?

Unfortunately, the day Black lives really mattered--the War between the States.  Our Constitution naturally recognized the natural rights to liberty and freedom for every man.  However, there were many--White, Black, and Native American--that perverted our economy with slave labor and our politics with tyranny.  Yes, children, Blacks, and Native Americans owned slaves too!  These perversions of economics and politics were an offense to those that respected our Preamble's intent, "We the People of the United States, in Order to form a more perfect Union..."  In the Civil War, the Democrats fought to maintain slavery in their states and those destined to become states.  The Republicans sought the greatest economic and political embargo by abolishing slavery in all of the states.  During this time, President Abraham Lincoln sought a process that would cover the debts of the Civil War and fully fund the military.  He was quite successful in achieving each through the levy of income taxes.  The first time in American federalism that such an activity took place.  Lincoln got Congress to pass the Revenue Act of 1861 thus, creating the Bureau of Internal Revenue and collecting taxes both domestic and foreign.  The income and property taxes were deemed essential as a result of the Civil War.  The Lincoln Administration and Congress passed it as a "National Emergency".  During its 10 year existence, the Act allowed Congress to collect over $340 million.  The Civil War Debts were completely paid off.

Knowing this, Americans began to question why any Congress or Administration would maintain the tax.  Due to its unpopularity, Congress finally repealed income taxes in 1872, although the Revenue Act of 1862 required the termination of income and property taxes by 1866.  Why the additional years?  Political leaders liked the new found power and influence that they had over the American economy.  They could promise to spend based on ideal pictures of tax revenue growth thus, creating budget deficits and national debt.  The greater the wealth confiscated, the more powerful legislatures would become in picking winners and losers in the economy.  The greatest champions of the federal power to tax income were the Progressive Republicans, Democrats, and Socialists.  In 1867, the Socialists demanded a graduated income tax.  In 1892, the Populist Party, which would later merge with the Democrat Party, demanded a graduated income tax through its Party Platform.  In 1894, Democrat William Jennings Bryan, three-time losing Presidential candidate, advocated for the passage of the income tax.  On May 21, 1895, the U.S. Supreme Court ruled that a direct tax on personal income was unconstitutional as a result of the case of Pollock v. Farmers‘ Loan and Trust Company. The lawsuit had been precipitated by the 1894 Income Tax Act.  The Supreme Court’s 5-4 decision stated that a “direct tax” on the “income of real and of personal property” was “unconstitutional and void.”  This only strengthened the resolve of the progressives and socialists to make income taxes law constitutional and replace Supreme Court originalists with modern pragmatists

Where were the Republicans, little ones?  In 1902, House Ways and Means Committee Chairman Sereno Payne (R-N.Y.) led a conservative charge to repeal the Spanish-American War tax and several others.  This did not sit well with Socialists, Establishment Democrats, and Progressive Republicans.  They were completely upset that "capitalists and corporatists" were not paying their "fair share".  In a speech on April 14, 1906, President "Teddy" Roosevelt endorsed a progressive estate tax:

"Of course no amount of charity in spending such fortunes in any way compensates for misconduct in making them. As a matter of personal conviction, and without pretending to discuss the details or formulate the system, I feel that we shall ultimately have to consider the adoption of some such scheme as that of a progressive tax on all fortunes, beyond a certain amount either given in life or devised or bequeathed upon death to any individual — a tax so framed as to put it out of the power of the owner of one of these enormous fortunes to hand on more than a certain amount to any one individual; the tax, of course, to be imposed by the National and not the State Government."

The Progressives, the Socialists, and the Democrats were in lockstep.  Successful Americans would be targeted with the tax pen.

O, Daddy, you are so wonderful to explain all of this to us.  I like the way you also take command in raising the volume on the television so that you project your voice without disturbing the sound.  Please tell us why the conservatives did not stop the War on the states by the federal government.

Daughters, you are so perceptive.  I know your mother sleeps but, I will raise the volume slightly and project my voice more.  Whether Lincoln or the Roosevelts, the Progressives, the Socialists, and the Democrats understood that centralizing economic planning in Washington, DC offered federal legislatures greater power and influence than any individual state legislator could possibly muster.  There was an additional secret weapon that they could call upon.  In the 1862 Revenue Act, Congress gave provision for the deduction of state and local taxes.  Their rationale?  A fear that high levels of federal taxation might “absorb all [the states’] taxable resources.”  Such a rationale reveals the motives of the income tax advocates.  They were going to coerce, by excessive tax laws, the American citizen to accept greater government intervention into their everyday lives.  It would no longer be "We The People" but, become "We The Government".

The Income Tax Power Lobbyists realized that the deduction of state and local taxes allowed high tax, high-income states to gain the greatest protections for their ideological pursuits.  The states with the highest taxes are [1] New York, $9,718; [2] California, $9,509; [3] Nebraska, $9,450; [4] Connecticut, $9,099; and [5] Illinois, $9,006.  The majority of these are Leftists states that subscribe to many Anti-American legislated policies.  The Left realized that they could pass their public policy experiment costs unto the rest of America through high taxes.  Wealthy taxpayers love it because it lowers their overall tax due.  States love it because it makes it easier for legislators to express support for costly bills.  Advocates love it because the public policy costs are passed on to others and not incurred in full by the citizens that enforce their recommendations.  In many of these states, conservatives have very little influence and certainly very few choices.

If the Congress would eliminate the deduction of state and local taxes then, taxpayers would be forced to hold their legislatures to higher fiscal standards.  Progressives and socialists might reconsider their ways.  They just might surrender their ideological pursuits for the financial good of the common man.  Voters may accept a more conservative fiscal policy for their states and cities.  Wow, actually, this might make it easier to vote conservatives into a political office where states and cities are most liberal.  The Conservative Movement may prevail in California, in New York, and in Illinois.  Unions, environmental groups, and progressive and socialist defenders may lose their lobbying power in Washington, DC.  K Street may finally bow to the power of Main Street...

All heads turn and there is utter silence.

A lovely woman with a frown stands at the door of my home office.  She gives me and the girls "The Look".  Men, if you have never seen "The Look" let me forewarn you, do not ask for it or desire seeing it.  "The Look" is at once debilitating and dehumanizing.  "The Look" can crush cans without human effort.  It makes young men weep and old men tremble.  All sounds ceased.  I do not know how the television screen faded to black but, it seemed to know the presence of my wife and, I suppose, it did not want to subject itself to viewing "The Look".  The girls escaped between "The Look" and the doorway as if they had been kidnapped and were happy to see the SWAT team arrive.

My wife revealed to me, as she sternly disinvited them from my office for the last time, that their only interest was watching television.  I was appalled!  How dare she libel my daughters and proclaim such accusations against their passionate curiosities?!  Unfortunately, I heard them at the bottom of the stairwell giggling and giving each other high fives.  My wife looked at me with such great pity.  How pathetic it is that a grown man could be so smitten by his daughters' cunning that he is easily manipulated into giving them privilege rather than justice.

It was years before I understood that my daughters were not interested in the Constitution, Economics, or American politics.  Let's hope it's not years before Congressional conservatives realize that breaking the Left's political hold on High-Tax, High Income Tax states and economic hold on the U. S. Treasury is as simple as eliminating the state and local taxes deduction.  Manipulation is a wonderful thing for the manipulator.  Wisdom is the key to freedom for the oppressed.  I pray that Congress is wise enough to use the key to free Americans from the oppression of the Left.  However, to believe so would be a maddening deception.  I no longer wish to be manipulated, except by my daughters.
